Senegal Policies Affecting Disinformation

From ADTAC Disinformation Inventory

Legislation

Senegal does not have specific legislation that covers disinformation, however the senegalese Penal Code criminalizes the dissemination or publishing of "fake news" if the stories have "led to disobedience to the laws of the country or harmed the morale of the population or brought discredit on public institutions or their functioning"[1][2]. The punishment is one to three years and a fine of 100,000 to 1,500,000 francs.[3]

Arrests Based on Legislation

The definition of fake news is unclear under the law and can be broadly applied. In 2020 there were summons from the police of citizens based on their denial of COVID-19.[4][5]
